2 Acceptance of Terms
By using our services, you confirm that:
You are at least 18 years old and legally capable of entering into contracts.
All information you provide is accurate, complete, and up-to-date.
You will comply with all applicable financial regulations and laws.
3 Payment Processing Services
📝 Merchant Accounts
- Account approval subject to verification
- Processing fees as agreed in contract
- Reserve hold may apply for high-risk businesses
💰 Transaction Processing
- Settlement within 1-2 business days
- Chargeback fees apply as per agreement
- PCI compliance required for all merchants
🔒 Security Requirements
- SSL certificate required on merchant website
- No storage of card data without encryption
- Immediate reporting of security breaches

5 Prohibited Activities

6 Limitation of Liability
Disclaimer: SwiftPos shall not be liable for:
- Indirect, incidental, or consequential damages
- Lost profits or business interruption
- Data loss beyond our control
- Third-party service failures (banks, networks)
Our total liability is limited to fees paid for services in the 12 months preceding the claim.
7 Termination
Either party may terminate the agreement:
By Client:
30 days written notice required. Early termination fees may apply.
By Company:
Immediate termination for breach of terms or illegal use.
8 Governing Law & Disputes
These Terms shall be governed by the laws of Texas, USA.
Any disputes will first attempt resolution through good faith negotiation. If unresolved, binding arbitration will apply as per the American Arbitration Association rules.
9 Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of revised Terms.
